OUR GENERAL TERMS AND CONDITIONS

1. SCOPE

For all orders via our online shop, the following terms and conditions apply.

2. CONTRACTUAL PARTNER, CUSTOMER SERVICE

The purchase agreement is concluded with Schmidt Bettwaren GmbH. More information about us can be found in the imprint. You can reach us for questions and complaints from Monday – Friday 09.00am – 6.00pm and Saturday 09.00am – 2.00pm via phone number 0641/74007.

3. CONCLUSION OF CONTRACT

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. The contract is concluded by accepting the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order you will receive a confirmation by e-mail.
The condition for an effective conclusion of the contract is always that the order process is completed when the order is placed.

4. SHIPPING COST

In addition to the stated product prices shipping costs are added. You can find out more about the amount of shipping costs in the offers.

5. PAYMENT

The payment is made in advance. Small products such as vouchers or DAGREWA products can be payed via PayPal.

We will give you our bank details in the order confirmation and deliver the goods after receipt of payment.

6. SELF DELIVERY

Is possible at any time during our opening hours.

7. PACK STATION

We do not deliver bulk products to packing stations.

8. OWNERSHIP

The goods remain our property until full payment.

9. TRANSPORT DAMAGE

If goods are delivered with obvious transport damage, please complain about soon as possible to the deliverer and please contact us immediately. The failure to file a complaint or contact has no consequences for your statutory claims and their enforcement, in particular can you use your warranty rights.

11. COST-COLLECTIVE AGREEMENT IN EXECUTION OF THE RIGHT OF REVOCATION

You have to bear the regular costs of the return, if the delivered goods correspond to the ordered ones and if the price of the returned goods does not exceed an amount of 40,00 Euro, or if at a higher price of the consumed product at the time of the revocation has not been considered or partial payment, which has been agreed, has not been fulfilled.

12. CONTRACTUAL LANGUAGE

The language available for the contract is German.

REVOCATION
You can cancel your contract within 14 days without giving reasons in writing (for example, letter, fax, e-mail) or – if you return the product before refund policy exceeds – by returning the goods. The refund policy starts after receipt of this instruction in text form, but not before receipt of the goods at the recipient (in the case of recurrent delivery of similar goods not before receipt of the first part delivery) and not before fulfillment of our information obligations under Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB as well as our obligations according to § 312g paragraph 1 sentence 1 BGB in connection with article 246 § 3 EGBGB. To maintain the cancellation period, the timely dispatch of the revocation or the thing is sufficient.

Consequences of revocation
In the case of an effective cancellation, the mutually received benefits shall be returned and any benefits (such as interest) incurred. If you can not give us back our products or give us the received performance as well as usages (eg use advantages) or only partially or only in a deteriorated condition, we ask you to pay us an compensation. For the deterioration of the product and for usage, you must only pay a value replacement, as far as the use or deterioration is due to a handling of the product, the “testing the characteristics and functioning” which means testing and trying out the product under same condition as you would do it in our store. Items that can be shipped by parcel must be returned at our risk. You have to bear the regular costs of the return, if the delivered commodity corresponds to the ordered and if the price of the product to be returned does not exceed an amount of 40 euro or if more expensive product at the period of refund policy has not been used.  Otherwise, the return is free of charge for you. Non-parcels products can be picked up at your place. Obligations only refund of payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the product, for us with their receipt.
